www.omps2.it (the “Site”) is operated by OMPS 2 S.R.L. Use of this Site is subject to these Terms of Use (“Terms of Use”). Where you (“User”) do not agree to the Terms of Use, you must immediately cease browsing the Site. By accessing the Site and its use you agree to the Terms of Use.

The Terms of Use constitute a contract between you and OMPS 2 S.R.L. and cannot be changed without the consent of OMPS 2 S.R.L.. These Terms of Use should be read with reference to every part of the Site regarding the operation of the site itself and the services available. Use of this Site is subject to the Terms of Use. The User is furthermore required to read OMPS 2 S.R.L.’s Privacy Policy. OMPS 2 S.R.L. reserves the right to unilaterally change the Terms of Use at any time without prior notice. Any changes will be published on the Website.

The offer and sale of products on our website (“www.omps2.it”) are governed by these General Conditions of Sale.

2. Our business policy

These General Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders for products on www.omps2.it between users of www.omps2.it and the Seller.

However, the General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller which are present on the site www.omps2.it through links, banners or other hypertext links. We advise you, before placing orders and purchasing products and services from parties other than the Seller, to verify their conditions of sale, as the Seller is not responsible for the provision of services by third parties or for the conclusion of e-commerce transactions between users of www.omps2.it and third parties.

3. Intellectual Property Rights

All content on this site, including by way of example, but not limited to, text, photographs, videos and images, is protected by copyright. OMPS 2 S.R.L., or its licensors, owns the copyright and/or database rights in the selection, coordination, arrangement and enhancement of such content, as well as of the original content. The product names or trademarks remain the property of the respective owners. Except as expressly stated in the Terms of Use, the User shall have no rights to intellectual property in the ownership of OMPS 2 S.R.L. or its licensors. The User shall not assert or attempt to obtain such intellectual property rights and may not use, copy, reproduce, modify, publish, transmit, participate in the transfer or sale, create derivative works from, or in any way exploit the name of OMPS 2 S.R.L., its trademarks, service brands, logo and other brands belonging to OMPS 2 S.R.L. or any other content of this site, either in full or in part, except as provided in the Terms of Use.

Users may download information from the Site for their own personal use, but not for commercial purposes. Unless otherwise stated by copyright laws, no copying, redistribution, transmission, publication or commercial exploitation of downloaded content shall be permitted without the express permission of OMPS 2 S.R.L., as well as that of the copyright owner of such intellectual property rights. Where the copying, redistribution or publication of copyrighted material is authorized, there shall be no changes in or deletion of author attribution, business brand communication legend or copyright. The User acknowledges that he acquires no intellectual property rights by downloading copyrighted content.

The rights granted to the User under the Terms of Use shall cease immediately upon any violation of the Terms of Use.

4. Links to the Site and to third-party websites

The Site may contain hyperlinks to websites operated by third parties. OMPS 2 S.R.L. is not responsible for content on third-party sites that refer to the Site, or that is referenced through the Site itself. The inclusion by OMPS 2 S.R.L. of hyperlinks to such websites does not imply any acceptance on the part of OMPS 2 S.R.L. of the material published on such websites, or any other relation between OMPS 2 S.R.L. and their administrators. The User may not set up hyperlinks to the Site from other sites, without a written agreement with OMPS 2 S.R.L.

5. Responsibilities of OMPS 2 S.R.L.

To the fullest extent that such liability can be excluded by law, OMPS 2 S.R.L. assumes no liability and makes no warranty in connection with the Site, its content or the content of any other site. To the extent required by law, OMPS 2 S.R.L. is not responsible for any direct or indirect damages of any kind. OMPS 2 S.R.L. accepts responsibility for death or personal injury caused by its negligence, for fraudulent misrepresentation or for any other liability which cannot, under Italyn law, be excluded.

6. Compensation

The User agrees to indemnify and hold harmless OMPS 2 S.R.L., its suppliers and their affiliates and related entities, and their respective directors, officers, employees and agents from and against any claim, loss, damage, liability, and costs (including, without limitation and within reason, lawyers' fees and legal costs) arising out of or relating to a breach of the Terms of Use or the access to or use of services of OMPS 2 S.R.L. by the User. The foregoing indemnification obligation shall survive the termination of the Terms of Use and the cessation of the operation of services of www.omps2.it or any product or service provided by OMPS 2 S.R.L.

7. Content provided by the User

Except as otherwise stated by the Terms of Use or in the information on OMPS 2 S.R.L.’s policy on the processing of personal data, any communication or content transmitted by the User to OMPS 2 S.R.L. via www.omps2.it, by electronic mail or otherwise, including, without limitation, any competition or lottery, images, photographs, video and audio files, essays, questions, comments, suggestions, or the like, is and will be treated as non-confidential and non-proprietary and may therefore be used by OMPS 2 S.R.L., its suppliers, or their affiliates or related entities for any purpose, including without limitation, the reproduction, modification, disclosure, transmission, publication, distribution, advertising and also for promotional purposes through any media without additional authorizations, approvals, payments, or other issues, if not prohibited by law. Moreover, OMPS 2 S.R.L., its suppliers and affiliates as well as their related parties shall be free to use any ideas, concepts, know-how or techniques contained in any communication sent by the User to OMPS 2 S.R.L. through the services of www.omps2.it for any purpose, including, without limitation, the development, marketing of products or services using the information contained in this communication.

8. Withdrawal

The Terms of Use are effective until withdrawal by OMPS 2 S.R.L.. OMPS 2 S.R.L. may withdraw from the Terms of Use at any time without prior notice, even partially and with reference to only one of the services offered by OMPS 2 S.R.L.. In case of withdrawal, the User will no longer be authorized to access the services of www.omps2.it, and the rights and obligations of Users relating to the content of waivers, liability limitation compensation set forth in the Terms of Use shall survive the termination of the effects of the Terms of Use. OMPS 2 S.R.L. also has the right to terminate, without prior notice and at any time, some or all of the servicesnor any part thereof, or products or services offered through them, or to prevent anyone from accessing or using the services of OMPS 2 S.R.L. or part thereof.

9. Compliance with the law

The User agrees to comply with all applicable laws, statutes, ordinances and regulations regarding the use of the services ofnand the purchase of products or services through them. Users must be at least 18 years of age to use the services of www.omps2.it.

10. Miscellaneous

Should any part of these Terms of Use be non-enforceable, all other parts shall remain valid and enforceable between the parties. The Terms of Use are subject to the law of the Italyn Republic and all disputes relating to the same, as well as to the Site, shall be subject to Italyn jurisdiction.

1. How to conclude the contract with OMPS 2 S.R.L.

To conclude the purchase contract of one or more products on www.omps2.it, you must fill out the order form and send it to the Seller electronically, following the relevant instructions.

The order form contains a link to these General Conditions of Sale and a summary of information on the main features of each product ordered, and its price (the price displayed on the website is exclusive of VAT). VAT will be shown in the “shopping cart” section and, if applicable in relation to the origin and the status of the company/private user, will be added during “checkout” or at the end of the order. These Terms and Conditions specify the following means of payment that can be used to buy each product, and the method of delivery of the purchased products, shipping and delivery costs, a reference to the conditions for exercising your right of withdrawal, and information on how and when you can return any products purchased.

The contract shall be concluded when the Seller receives your order form electronically, after verifying the accuracy of the data relating to your order.

Prior to purchasing products by sending the order form, you will be asked to accept the General Conditions of Use and Sale and to authorize the processing of personal data in accordance with article 13 of Legislative Decree no. 196/2003. You can read the General Terms of Use and Sale and Information on the processing of personal information by following the video links prior to proceeding with the purchase.

The order form will be filed in our database for the period of time required to process your order, as provided by law. You may access your order form by referring to the “orders” section in “My Account”.

Before submitting the order form, you will be asked to identify and correct any data errors.

The languages available for concluding the contract with the Seller are Italyn and English.

When the contract has been concluded, OMPS 2 S.R.L. will process your purchase order.

The Seller may not process purchase orders which do not provide sufficient guarantees of solvency or which are incomplete or incorrect, or in the event of unavailability of products.

In these cases we will inform you by e-mail that the contract has not been concluded and that the Seller has not carried out your purchase order, specifying the reasons.

If the products displayed on www.omps2.it re no longer available or no longer for sale at the time of your last visit to the site, or at the time of sending the order form, the Seller will inform you promptly and in any case within thirty (30) days from the day following the day on which you sent your order to the Seller, that the products ordered are unavailable. If the order form has been sent and payment has been made, the Seller will refund you the sum paid.

By electronically sending the order form, you unconditionally accept and undertake to observe, in relation to the Seller, these General Conditions of Sale. If you do not agree with any of the terms in the General Conditions of Sale, please do not submit your order form for the purchase of products on www.omps2.it.

By submitting the order form you confirm your knowledge and acceptance of the General Conditions of Sale and additional information contained in www.omps2.it, also through links, including the General Conditions of Use and Sale information regarding the use of personal data.

On conclusion of the contract, the Seller will send you by e-mail, a receipt of the purchase order, containing a summary of the information contained in the order form, as well as information on the essential characteristics of the product and detailed indication of the price, payment terms and delivery costs).

2. Guarantees and product prices

On our site www.omps2.it, in the section Weapons Parts, we sell genuine Beretta, Benelli and Diana spare parts, and spare parts produced by OMPS 2 S.R.L.; the products are provided directly by the companies, and are therefore original products.

In the Tools and Accessories section, we have for sale products made by various different manufacturers; OMPS 2 S.r.l. takes care of their distribution.

All products in the sections for Weapons Spare Parts and Equipment and Accessories are top quality and are selected for their stringent quality controls.

The essential characteristics of products are shown on www.omps2.it within each product page. The images and colours of the products offered for sale on www.omps2.it may not exactly correspond to the actual images and colours due to the effect of the Internet browser or monitor used.

Product prices may be subject to change. Check the final price of sale before sending the order form.

Should you exercise your Right of Withdrawal, the Seller is entitled to refuse the return of products which have been altered from their original status or have been damaged.

Discounts for armoury

Should the User prove to be an armoury with a regular Italyn, EU or non-EU VAT number, he can request access to the catalogue with discounted prices. To be eligible for this benefit the User must register with the site, then send all documentation certifying the status of the armoury (such as official company registration details showing the business activity), to info@omps2.it. Upon receipt and verification of the documentation, OMPS 2 S.R.L. will change the status of the user type from “basic” to “armoury”. The User can then log back into the site and browse the catalogue showing discounted prices.

VAT

The prices shown on the site www.omps2.it are EXCLUSIVE of VAT.

During checkout, the site www.omps2.it will, depending on the data entered, carry out the following calculation:

• If the User is a private individual or a company with an Italyn VAT number: VAT will be added at the current rate according to legislation;
• If the User is a private individual in the European Union: VAT will be added at the current rate according to legislation;
• If the User is a company in the European Union (with a VAT number in one of the states of the European Union): NO VAT will be added to the total amount;
• If the User is a private individual or a company outside the European Union: NO VAT will be added to the total.

3. Payments

For all products delivered, OMPS 2 S.R.L. will issue a receipt with the data provided by the Customer. If customers require an invoice, this must be requested when the order is placed, specifying the name of the company and VAT number in the “Billing Information”.

The methods of payment accepted by OMPS 2 S.R.L. on www.omps2.it are:

• PayPal and Credit Cards (via the PayPal web site);
• Bank Transfer (account in the name of OMPS 2 S.R.L. - IBAN: IT29S0869283790024000241155);
• Cash on delivery (for Italy only - a surcharge of 2.5% of the goods+shipping will be applied - minimum cost: €4 per delivery).

After the goods in the order have been prepared, OMPS 2 S.R.L. entrusts the order to the Courier. The time frame for goods passed to the Courier varies depending on the method of payment chosen:

• PayPal, Credit Card or Cash on delivery: the products are entrusted to the courier the same day or the next business day after the order was placed.
• Bank Transfer: the products are entrusted to the courier on the next business day following receipt of payment into the OMPS 2 S.R.L. account (on average 3/5 business days after the customer has made the payment).
• Credit card or PayPal: payments will be made through the PayPal web site; OMPS 2 S.R.L. does not collect or store any financial information (for example, the credit/debit card number or expiry date). This data will therefore never be requested on www.omps2.it, but exclusively on the PayPal site.

4. Shipping and delivery of products

Please pay attention to the information in this section, as it is an integral and essential part of these General Terms of Sale; therefore, when the order form is sent, it is implicit that you have read and accept these conditions.

Delivery methods

Deliveries are made on Business Days between the hours of 8.30am and 6pm. Delivery is to street level for all products. The Courier makes the first delivery without prior notice. If the Customer is absent, the Courier will leave a note to advise that delivery has been attempted (a note in the mailbox or sticker on the bell) and will re-attempt delivery on the following Business Day. If this delivery attempt is also unsuccessful, the customer will be contacted by the staff of OMPS 2 S.R.L. to arrange a further delivery. The cost of holding or storing deliveries at the courier’s premises shall be borne by OMPS 2 S.R.L. for the first 2 days, beyond which these costs will be charged to the customer. Deliveries will only be made to ground level.

Upon delivery of the goods by the Courier, the customer is required to check:

• > that the number of boxes is the same as indicated in the Courier’s accompanying document
• > that the packaging is intact, undamaged, not wet and has not been tampered with.

Once the Courier’s delivery note has been signed, the Customer may no longer make any objections regarding the external appearance of the delivery package.

If the package is tampered with or damaged upon delivery, please do not collect it. In case of withdrawal we will not accept claims for missing or damaged goods.

Delivery times

If the goods are in stock at OMPS 2 S.R.L.’s warehouse, delivery is made within 24-48 hours (for Italy and Europe) and 48-72 (for locations outside Europe).

If the goods are not immediately available at the warehouse, OMPS 2 S.R.L. must wait for receipt of the goods from the manufacturer before carrying out the delivery.

If the components are not listed on the categories pages, they are currently unavailable or out of stock.

If it is impossible to supply the goods, or if they can only be supplied after a long delay, we shall agree with the customer for a replacement product to be provided, or we shall refund the order, if it has already been paid for.

For countries that are not listed in the shipping costs table, it may be possible for us to offer a personalized delivery service. The User must write to OMPS 2 S.R.L. at info@omps2.it, indicating the exact products required, and the full delivery address (name, surname, street address, postcode/zip code, city, state, region and country, as well as a contact telephone number). When OMPS 2 S.R.L. has received the information and verified the shipping options, the company will provide the User with a personalized quote.

Weight Limits

For orders over 100kg (Italy) or 70kg (rest of the world), orders cannot be made online through online www.omps2.it. To receive a personalized quote, you will need to write to OMPS 2 S.R.L. at info@omps2.it indicating the exact products required, and the full delivery address (name, surname, street address, postcode/zip code, city, state, region and country, as well as a contact telephone number). When OMPS 2 S.R.L. has received the information and verified the shipping options, the company will provide the User with a personalized quote.

Customs Fees

Any customs fees will be charged to the recipient. These expenses do not depend on OMPS 2 S.R.L..

5. Customer Services

6. Right of Withdrawal

You have the right to terminate the contract with the Seller, without penalty and without specifying the reason, within ten (10) working days from the day of receipt of goods purchased on www.omps2.it.

To cancel the contract you must contact OMPS 2 S.R.L. via email (info@omps2.it) or by calling +39 030 832 176 to notify them that you intend to avail of the right of withdrawal.

In this event, you must return the products to the Seller, delivering them to the courier for shipment within ten (10) working days from when you received the goods.

The only expenses charged to you are for returning any products purchased.

The right of withdrawal - besides complying with the terms and conditions described in the previous points - is deemed to be properly exercised when the following conditions are fully met:

• notice of withdrawal to the Seller within ten (10) working days from receipt of the products;
• products must not be damaged;
• products must be returned in their original packaging;
• products must be returned to the Seller in a single shipment. The Seller, indeed, reserves the right not to accept products from the same order which are returned and delivered at different times;
• returned products must be delivered to the shipping company within ten (10) working days from the date you received the products.

If the return right is exercised in conformity with the procedures and time limits specified in this paragraph, the Seller shall refund the amount received for the purchase of products on the conditions and terms provided.

The amount will be reimbursed as soon as possible and in any event within thirty (30) days from the date on which the Seller became aware of your withdrawal, we will activate the refund procedure, as soon as the correct execution of the terms and conditions stated above has been verified.

If the procedures and terms for exercising your right of withdrawal, as specified in this paragraph (6) are not respected, you will not be entitled to a refund of the money paid to the Seller; however, you are entitled to have the products returned to you, at your expense, in the state in which they were returned to the Seller. Otherwise, the Seller has the right to keep the products in addition to sums already paid for their purchase.

7. Time frames and methods of reimbursement

After products are returned, the Seller shall carry out the necessary investigations relating to compliance with the terms and conditions described in paragraph 6. If the checks are successfully concluded, the Seller shall send you, via email, a confirmation of acceptance of the returned products.

Whichever mode of payment you used, the refund is activated by the Seller in the shortest time possible and in any case within thirty (30) days from the date on which the Seller became aware of your right of withdrawal and after the correct execution of your right of withdrawal has been verified, and returned products have been accepted.

If there is no correspondence between the recipient of the goods specified in the order form and the person who paid for their purchase, the reimbursement of sums in the event of exercise of the right of withdrawal, will be performed by the Seller, in any case, in favour of the person who made the payment.
